Democrats Accidentally Reveal How They Plan to Handle Elon Musk If They Win the Majorities in Congress in the Midterms

"He's at the top of that list."

That's tech journalist Kara Swisher on the Bulwark podcast, explaining what Democrats plan to do with Elon Musk if they win the House and Senate in the midterms. Not regulate him. Not out-compete him. Investigate him. Jail him.

She wasn't speculating. She was promising.

Swisher laid out Democrats plans, "If Donald Trump loses the House and the Senate, I would worry. I'd be worried if I were him." The "him" being Musk. "So they're going to start investigating again. You think he's not on the list? He's at the top of that list."

Then she added the part that would've been a scandal in any era where the press still pretended to be objective: "He has a very big sense of fate. And I think it's coming for him. And real hard."

Watch her out her party's plans like its nothing

This is a prominent media figure — not some anonymous DNC operative — sitting on a podcast and casually describing the imprisonment of a private American citizen as a campaign platform. Vote for us, and we'll put the richest man in the world behind bars for the crime of backing the wrong candidate.

We've watched this playbook before. The party that spent four years insisting "no one is above the law" while pardoning Hunter Biden has found its next target. The party that told us democracy was sacred while trying to remove a frontrunner from the ballot now wants voters to know: elect us, and the investigations start on day one.

Swisher didn't frame this as a warning. She framed it as a selling point.

And that's what makes it useful. Not as outrage bait — we've had plenty. As evidence. The midterm pitch from the Democratic coalition isn't "here's what we'll build." It's "here's who we'll destroy."

Elon Musk's crime, in their telling, is political opposition. He bought Twitter, renamed it X, and stopped censoring the people they wanted censored. He made the news citizens based, not based on anonymous sources from biased liberal journalists. He backed President Trump publicly and loudly. He used his platform and his wallet to support candidates and causes the establishment despised. For this, a major media figure says he belongs in a cell.

There was a time when this kind of talk got buried in private fundraiser speeches and leaked emails. Now it's a podcast segment. Swisher didn't whisper it to donors in a closed room. She said it into a microphone, on a show with her name attached, knowing it would be clipped and shared. She wanted people to hear it.

The calculation isn't complicated: the Democratic base wants retribution more than policy. They don't need a healthcare plan or an infrastructure bill. They need someone to punish. Musk is the biggest target available, and Swisher just confirmed he's been measured for the fitting.

This is the same political ecosystem that watched Anthony Fauci receive a preemptive pardon from President Biden and called it "protecting public service." The same ecosystem that treated Hunter Biden's pardon as an act of fatherly love. Pardons for allies, prosecutions for enemies. The principle has never been subtle.

What Swisher described isn't a justice system working as intended. It's a political apparatus that identifies its opponents, manufactures the legal framework to target them, and then campaigns on the promise of pulling the trigger. The investigation isn't the means to find wrongdoing. The investigation is the punishment. Subpoenas, depositions, legal fees, headlines — all designed to make the cost of political opposition so high that the next billionaire thinks twice before donating to a Republican.

Every GOP candidate running in a competitive midterm district should clip Swisher's quote and run it as a campaign ad tomorrow. No commentary needed. Just her words, her face, her promise.

"He's at the top of that list."

"It's coming for him. And real hard."

Swisher meant it as a threat. It works better as a recruitment poster.
